Corporate bankruptcies large and small are filed in Delaware or Manhattan far more often than in the debtor company’s home state. Why? Current bankruptcy venue law permits forum shopping unlike any other federal practice. Forum shopping concentrates cases and development of law and practice in primarily two federal districts, often thousands of miles away from the most affected individuals and communities, and impacts our bankruptcy law and federal judicial system.
This brown bag lunch program will explore arguments for and against venue reform, review the current law and proposed amendments, and discuss what’s next.
