New Bankruptcy Forms Effective December 1

New bankruptcy forms take effect December 1, 2015 and will apply to all cases filed on or after December 1.

These new forms are part of a forms modernization project that was begun by the Advisory Committee on Bankruptcy Rules in 2008. Among other things, the new forms introduce different versions of case opening forms for individual debtors and non-individual debtors.

The new forms are easier for debtors to understand and complete and are designed to work with scheduled enhancements to the federal courts’ case opening and electronic case management system. The forms starting with 100 will be used for case opening forms for individual debtors, the 200’s are used for case-opening for non-individual debtors, the 300’s for court notices and orders, and the 400’s for later filed documents.

There are new instruction booklets which should help debtors understand what is being asked by the new forms.

There are also Federal Rule of Civil Procedure Amendments set to take effect December 1 including Rules 1,4,16,26,30,31,33,34,37, and 55.
